I. General Provisions

 

A.   Principle

 

The protection of our customers’ privacy and the handling of personal data is very important to Montech.

 

We process your data in accordance with the applicable legislation for the protection of personal data, in particular the EU General Data Protection Regulation (EU-DS-GVO) and the country-specific laws that apply to us.

 

With the help of this Privacy Policy we provide you with detailed information on how and for what purposes Montech AG (hereinafter referred to as “Montech”) collects and processes personal data through its website and other Montech-operated websites and applications (hereinafter referred to as “Website/Tools”).

 

Personal data (hereinafter referred to as “data”) is information that makes it possible to identify a natural person. This includes in particular name, date of birth, address, telephone number, e-mail address but also your IP address.

 

Under Section I of this privacy policy you will find the general data protection information. Under Section II, the provisions with regard to data collection and processing in connection with our services. Under Section III you will find further instances where data collection and processing is used.

 

B.   Use of the website and cookies

 

You can visit the Montech website and obtain information about our products and services without disclosing personal data. We only request personal data where required for the performance of our own services (see Section II, Part A).

 

To make our website work properly, we sometimes place data files called «Cookies» on your device. Cookies are small text files that a website saves on your local hard drive when visiting our site. These cookies enable us to analyze how users use our website. This allows us to design the website content according to the visitor’s needs.

 

Moreover, cookies enable the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, so you don’t have to keep reentering them whenever you return to the site or browse from one page to another.

 

When accessing our website, our system uses cookies to automatically collect technical information from the calling computer. This is information about your browsing behavior; such as websites from which the user’s system has come to our website, as well as websites accessed by the user’s system through our website, entry and exit points for the website, search terms, and page views.

 

One type of cookie we use is Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses so-called “cookies”, text files which are stored on your computer and which allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website (including your IP address) is transferred to a Google server in the USA and stored there.

 

Google will use this information to evaluate your use of the website, to compile reports on the website activity for the website operators and to provide other services connected with the use of the website and the Internet. Google may also transfer this information to third parties, provided this is required by law or if third parties process this data on behalf of Google. Google will in no case associate your IP address with other data from Google.

 

In addition to reporting website usage statistics, Google Analytics can also be used, together with some of the advertising cookies described above, to help show more relevant ads on Google products (like Google Search) and across the web.
As a user you have full control over the use of cookies. By changing the settings in your internet browser, you can disable or restrict the transmission of cookies. Furthermore, already set cookies can be deleted at any time via the Internet browser. This is possible in all common internet browsers.

 

Please be aware that by deactivating or restricting cookies, it may not be possible anymore to fully use all functions of our website.

 

C.   Social Plugins of social networks

 

We use so-called social plug-ins from various providers/networks (for example, facebook, twitter, google+, linkedin, xing, etc.) such as the “Like-Button”. These plug-ins are provided and operated directly by these providers and are clearly identified with their company logo. If you visit a page that contains such a plug-in, your browser will establish a connection to the servers of those providers. The content of the plug-in is then transmitted by these providers directly to your browser and displayed in our environment without any influence by us on the content of this plug-in.

 

D.   Storage of customer data

 

We store your personal data at least to the extent and as long as it is necessary to provide our services and we are required by the law to do so.

 

For legal and accounting reasons, Montech stores the personal data collected from customers for the purpose of conducting business activities and services for 10 years after the last processing operation. We store other data as long as it is necessary for the execution of the contract and to safeguard our rights. We reserve the right to apply longer statutory and operational storage requirements and reasons.

 

Personal data collected for marketing activities is generally deleted only if this is requested explicitly by the customer.

 

E.   Data security

 

We protect your personal data by means of appropriate technical and organizational security measures and store it solely on secure servers. The website is secured against loss, destruction and manipulation by means of customary measures in accordance with the state of the art and against access, modification or distribution by unauthorized persons. Especially sensitive data (e.g. access data for your profile account) is encrypted during transmission via the internet (SSL).

 

However, Montech does not assume any guarantee for the security of your data. It is your responsibility to make an up-to-date back-up of the transferred data at all times and store it separately from the website. You are also responsible for creating a secure password for your customer account, keeping it safe and changing it on regular basis.

 

F.   Rights of Customers

 

You have the right to information, correction, deletion and transferability of your data. Furthermore, you have the right to restrict processing.

 

Paragraph «D Storage of customer data» and other statutory exceptions are reserved.

 

You have the right to object to the processing of your personal data. An objection only has future effect and does not affect previous processing. If, on account of the objection, Montech is no longer able to perform the services contractually agreed with you, the objection is deemed to be a breach of contract by the customer and Montech has the right to terminate its contract with you without notice. Costs incurred that have already been rendered as services (including the commencement of material procurement and order processing) are to be paid by the customer.

 

For the assertion of these rights, you can contact Montech at the address given in paragraph «G. Contact». The same applies if you have questions about data processing in our company. You also have the right to file a complaint directed at the competent regulatory authority.

II.   Processing of personal data in connection with the performance of our business services

 

A.   Purpose of data processing

 

For the purpose of providing our business services, including in particular the following points, we may collect and process personal data:
– Quotes
– Order confirmation and processing,
– Invoicing,
– Issuing credit notes,
– Transportation of goods
– Export- and import formalities as well as customs declaration (customs and VAT),
– Communication with the customer (newsletter, emails, Outlook),
– Improving Montech’s offerings and positioning in the market,
– Marketing/Advertising,
– Website/Tools activities (including orders, configurations, CAD and data downloads, live chat, visited Montech websites, usage patterns)

 

B.   Sharing of data with third parties and authorities

 

If necessary for the performance of our own services, we will disclose personal data to third parties (see Section II, paragraph A and in particular Section III, paragraph F).

 

Otherwise, a disclosure to third parties doesn’t occur unless we have obtained your consent to do so or are required to do so by law (disclosure to external authorities such as regulatory or law enforcement agencies, customs administration, VAT administration, tax administration).

 

III.   Application cases

 

A.   Montech.com Profile

 

1. Purpose of the montech.com profile

 

You have the option of creating and editing your own montech.com profile on the website. The montech.com profile allows you to simplify the process of ordering items, configuring products and using other services such as: download of CAD data and product information, obtain information and receive further Montech offers, information and services.

 

2. Personal data collected for the creation and operation of your profile

 

When you set up a montech.com profile, we ask for your personal data, in particular your surname, first name, date of birth, telephone number and e-mail address. To set up your profile we use the so-called double opt-in procedure: After you have registered, we send you a notification e-mail. You can confirm the setup of your profile by clicking on a corresponding activation link.

 

In order to fulfill and process the orders, configurations, etc. you have initiated you are required to enter the following additional information in your profile: your preferred method of payment, your address details (office , billing and/or delivery address).

 

Montech is entitled to process the data you share with us as part of the use of your montech.com profile, so that we can meet the resulting contractual obligations and operate your montech.com profile.

 

3. Sharing of data within the Montech Group and with third parties

 

Montech will collect and process the data you share with us in your montech.com profile and/or during your use of a function of the montech.com profile and which is required for the use of your montech.com profile (e.g. personal data, non-personal data and information) within Montech, and may transfer data to companies of the Montech Group, of which Montech is also a part, for the purposes stated in this Privacy Statement. In addition, third-party companies designated by Montech for the technical management of the montech.com profile may also obtain access to your data in the course of this activity.

 

4. Marketing activities and personalized advertising

 

Montech has set itself the goal of providing you with the most intuitive and easy shopping experience possible, which is tailored to you and your personal wishes and expectations from the first visit of our website/tools to the end of the service.

For this purpose, Montech processes your personal data collected in the course of registration and use of your montech.com profile for marketing and analytical activities. As part of its marketing and analytical activities, Montech may send you offers, for instance about Montech products and services which are similar or the same as others you have purchased or used previously. If you do not wish to receive such offers, you can edit your montech.com profile or request the deletion of your montech.com profile by contacting the address given under Paragraph «G. Contact» (Section I) at any time.

 

4.2. Personalized information and offers

 

When you set up a montech.com profile, we combine data about your consumption and usage patterns with Montech and companies of the Montech Group and analyze it, in order to provide you with relevant, personalized information and offers tailored to your interests (e.g. recommendations for specific products or services). By setting up your montech.com profile, you agree that we may provide you with such information and offers.

 

4.3. Market research

 

As part of our market research activities, Montech may invite you to take part in surveys to improve our products and services.

 

4.4. Electronic communication

 

By setting up a montech.com profile, you give us permission to send you relevant information, recommendations and offers from Montech and companies of the Montech Group. This takes place by means of non-analogue communication, such as email, telephone, SMS or instant messaging, for example. If you do not wish to receive such communications, you can edit your montech.com profile or request the deletion of your montech.com profile by contacting the address given under Paragraph «G. Contact» (Section I) at any time.

 

5. Deleting your montech.com profile

 

You may request the deletion of your montech.com profile by contacting the address given under Paragraph «G. Contact» (Section I) at any time without giving reasons. Your profile can then no longer be used and reactivated.

 

If you request the deletion of your montech.com profile, Montech will fully delete or anonymize the personal data contained in your profile. Statutory and operational storage requirements or reasons are reserved by Montech.

 

B.   Newsletters

 

We will keep you informed about relevant products and offers from Montech.

 

If you no longer wish to receive such information from Montech, you can terminate this service at any time by using the designated opt-out option and thus revoke your consent. Doing so will not restrict the use of your montech.com profile.

 

We process your data associated with the newsletter in order to send you news about and related to Montech. In addition, we also process and use the e-mail address you have entered in order to send you personalized offers associated with the newsletter.

 

If a link in the newsletter directs you to our websites, you also give us permission to process and use your IP address, together with geodata, web beacons or similar technologies, in order to verify whether the offers presented to you in the course of this communication meet your requirements.

 

Montech works together with external service providers for the dispatch of the newsletter.

 

C.   Customer service

 

As part of analytical activities and in order to offer you a better customer experience, Montech will send you periodically emails, which inquire the current status of an offer or which inform you about the current status of your order.
For the dispatch of such emails Montech works together with external service providers.

 

If you no longer wish to receive such emails, you can unsubscribe from these free of charge at any time via the link provided in the corresponding email.

 

D.   Live Chat Service

 

Montech provides you with online advice on montech.com in the form of a live chat service. Montech employees see your details during a chat session on the Montech website (collected via a cookie of this tool) that helps him/her to assist you. In addition, the Montech employees have access to the Montech ERP database system (e.g. database with order, invoices, etc.) and can check certain data on your behalf.

 

E.   Customer satisfaction survey

Montech may ask you to take part in customer satisfaction surveys after the completion of a business activity. If you no longer wish to receive such requests or emails, you can unsubscribe from these free of charge at any time via the link provided in the corresponding email.

 

F.   Deliveries/transportation

 

For the transportation of the products ordered by you, we usually hire third-party companies. For the registration of a transport order, we send this third-party company personal contact data (name, first name, address, email address and telephone number) so that they know at the time of delivery where the goods have to be delivered resp. to whom they have to apply when delivering.

 

G.   Job application

 

We appreciate your interest in working for Montech. We are aware of the significance of your submitted personal data and process it only for the purpose of the effective and correct handling of the application process and in order to contact you during the application process. There is no transfer of personal data to third parties without your consent.

 

If you apply online with us, we store and process the following personal data:
– Name, first name, name addition, date of birth, nationality, title
– If necessary, family status, civil status, religious affiliation
– Qualification and training data (e.g. curriculum vitae, certificates)
– Contact details (address, telephone number, email address)
– If applicable, work permit / residence permit
– If necessary, language and IT skills
– Further (voluntary) information such as e.g. earliest entry date, salary expectations, etc.
